These General Terms and Conditions (hereinafter: GTC) define the general conditions for the participation of webshop users / ticket buyers (hereinafter: Customers) and visitors (hereinafter: Visitors) in courses, lectures, workshops, festivals related to awareness, self-knowledge, self-development (hereinafter: Event) organized and held by InSpiral Event Kft. (registered office: 1031 Budapest, Zrínyi u. 32., company registration number: 01-10-049066, hereinafter: Everness), as well as the rights and obligations arising from the legal relationships between Everness and the Customers and Visitors (hereinafter: Contracting Parties).

The provisions of these GTC shall in all cases govern participation in the Event and the legal relationship between Everness and Visitors. Everness shall publish these GTC on its website (everness.hu/aszf) and upon online ticket purchase that creates a given contractual relationship, and shall make them available at its headquarters and at the entry points of the Event, in a printed, locally readable form.

Definitions of terms

Event: A course, lecture, workshop, festival organized by Everness on any topic, but generally related to self-knowledge, awareness and self-development;

Festival: Everness Festival is a multi-day celebration of consciousness, a collection of performing arts, music, entertainment, cultural, movement programs and other services held annually at a given time and place;

Buyer: a natural or legal person who purchases a ticket for a given Event, either as an online user or in person on site or at points of sale;

Visitor: a natural person who participates in a given Event as a person entitled to enter;

Service: any service that Everness or its contractual partners make available to Visitors at the Event, either free of charge or for a fee.

Webstore: Operates an online ticket sales system to facilitate the purchase of various tickets, accommodation, parking permits, and shopping vouchers for its own Events.

Ticket: A certificate given during the purchase of a ticket entitling you to participate in Events organized by Everness (either free or with reimbursement of costs), which can be a season ticket/student pass, e-ticket, day ticket, entrance ticket, honorarium, etc. (a serially numbered voucher suitable for unique identification).

House Rules: a document containing specific mandatory provisions for each Event, established with regard to the circumstances of the given Event, which contains the own rules of the area/room/company hosting the Event and is available on the website of Everness or the company hosting the Event, and upon request, for inspection at the location of the Events.


  1. SCOPE OF THE GTC

2.1. These GTC are valid for an indefinite period.

2.2. The Visitor acknowledges that Everness is entitled to amend these GTC unilaterally, informing the affected parties and accompanied by a public announcement. The amendments shall enter into force immediately upon publication on the Everness website. If the amendment affects the legal relationship pursuant to point 4.2 (i.e. not exclusively the ticket purchase process pursuant to point 5), the Customer/Visitor shall have the right to withdraw from this legal relationship in writing within fourteen days from this date without giving any reason, provided that he/she has not yet started attending the Event. The Customer/Visitor shall not have the right to withdraw if the amendment contains provisions that are more favorable to the Visitors only.


  1. CONTRACTUAL RELATIONSHIP

3.1. By paying the price of the Ticket and handing over the Ticket by Everness' sales partner, the Parties enter into a contractual relationship with each other. Everness provides the Customer/Visitor with the opportunity to participate in a given Event.

The ticket is a civil law contract between the Customer and InSpiral Event Kft. The Event Organizer considers the purchase of the ticket as a legal declaration and as an acknowledgement of the rules governing the use of the service covered by these GTC.

In connection with the online purchase of the ticket, the data required for its electronic issuance, which is acquired by the Event Organizer, will be processed exclusively for the purpose specified here, and will not be disclosed to third parties - except for legal/authority obligations - and will be stored exclusively for the period necessary for the organization and administration of this event.

If the Event is cancelled, the Customer will be informed about the details of the ticket refund on the Event website (everness.hu). In the event of the Event being cancelled, the Customer will not be entitled to any other claim or compensation from the Event Organizer other than the ticket price.

Except in the event that the Event is cancelled, the Event Organizer will not exchange or refund tickets.


3.2 The content and quantity of specific programs and Services available at the Events are determined by Everness as the Organizer and Director, but their content, quality and quantity (such as the performance of a given artist) are not guaranteed to the Visitor and the program reserves the right to change. However, Everness always strives to provide the previously communicated programs and Services, or to replace previously communicated and cancelled programs with a program of similar quality.

The event organizer reserves the right to change the date and location, and assumes no liability for any alleged damages resulting from this.


  1. ENTRY, ENTRY PURCHASE, ENTRY

4.1. Admission prices can be found on the Tixa website. https://www.tixa.hu/everness-2025

4.2. Electronic ticket purchase

Everness is a contractual partner ofTIXA Hungary Ltd.on its website (https://www.tixa.hu/everness-2025) provides convenient and secure online payment for its customers.

The customer's bank card details are not received by Everness. Payment is made directly on the website operated by them, which operates in accordance with the rules and security regulations of international card companies, and not on the Everness website. Everness does not have any information about the customer's card or the underlying account, including its number and expiration date, and cannot access them.

After providing the necessary data and successful financial payment, Tixa.hu will send the Customer's ticket in .pdf format by e-mail to the e-mail address provided during the order. The Customer/Visitor must present the voucher either printed out or on a suitable electronic device (phone, i-pad, tablet, laptop) upon entering the Event, based on which he will receive the wristband entitling him to entry at the entrance gate.

4.3. Vouchers are personal, and the Buyer/Visitor is only entitled to transfer them to Everness' contractual partner on the TicketSwap website.https://www.ticketswap.com/everness-fesztival


4.4 Everness provides the opportunity to purchase tickets in person on-site only during the duration of the Event.


4.5. Wristband
After entry, the rights and obligations of the entrant are embodied in the wristband, the integrity and wearing of which are checked by Everness and its collaborating partners (security professionals) at the entrance gates and throughout the Event area. Persons staying at the Event venue without authorization are required to leave the venue immediately. A damaged wristband is invalid, and Everness will not replace a wristband that is damaged, lost, or tampered with in any way.

  1. RULES OF CONDUCT

5.1. Visitors are obliged to observe the general standards of conduct in the Event area and to behave in accordance with these GTC and the House Rules of the current hosts and to refrain from any manifestation or action that may violate or endanger the personal rights, health, physical integrity or life of others, or that hinders or disturbs the purpose of the Event Visitors' stay, their entertainment or their recharge. Given the nature of Everness Events, Visitors pay special attention to the protection of natural values both at the Event location and in its surroundings.

5.2. Any promotional or advertising activities, commercial or economic activities, or fundraising at the Event venue are prohibited without the prior written permission of Everness.


5.3. It is prohibited to serve alcoholic beverages to persons under the age of 18 or to intoxicated persons in the Event area. Salespeople in commercial and catering establishments are entitled to request the Visitor to present identification documents to prove age. The consumption of substances classified as narcotics in the Event area is prohibited and is punishable by law.

5.4. It is prohibited to organize or hold any gatherings or demonstrations outside of and unrelated to the organized programs without prior notice and without the written permission of Everness. Everness is entitled to terminate such organization immediately and, upon notice, to remove from the Event those participants who do not suspend their activities even upon request by Everness or its collaborating partners (security professionals).

5.5. Everness's professionally qualified and licensed Contributors in the Event area will ensure the enforcement and compliance with the rules of conduct and safety. The Visitor undertakes to cooperate fully with these professionals and to follow their instructions immediately in the event of an emergency.



  1. AUDIO AND IMAGE RECORDING

6.1. The Visitor acknowledges that Everness may make video and audio recordings of the event, as well as of its contracted partners, collaborators, other Visitors and third parties. Accordingly, the Visitor expressly consents to the recording and publication of his/her face, appearance and expressions, provided that he/she may only be named with his/her express consent. An exception to this is if the person is a public figure, who may be named without his/her consent.


6.2. In the above appearances, the creator has the right to utilize and use the appearance without restriction with respect to the Visitor (promoting the Event, duplicating, publishing, reworking, making public, broadcasting to the public online and offline, during simultaneous and subsequent use, etc.), without having to provide any compensation to the Visitor for this. The Visitor is not entitled to make any claims or demands against Everness in connection with the above.

6.3. Visitors are entitled to make video and audio recordings at the Event, provided that the Visitor may not sell or exploit the video and audio recordings made by him/her for a fee (or for commercial purposes, even without a fee). Visitors appearing in the recordings may not be named without their express consent, and their personal rights may not be violated. Everness expressly excludes its liability in the event that Visitors do not comply with the provisions of this Section 6.


7. FIRST AID, MEDICAL CARE

24-hour medical assistance is provided at the designated location at the Event venue. Visitors are entitled to use this service within the framework of valid social security, health or travel insurance. If they do not have any of the above, they are entitled to use the service for a fee.



  1. HOUSE RULES

Everness makes the Rules of Procedure for a given Event available on its website and, upon request, at the main entrance to the Event. In addition to the provisions of these GTC, Visitors are also required to fully comply with the rules and regulations set out in the Rules of Procedure for the given Event.

  1. LIABILITY

9.1. Everness reserves the right to modify or adjust the concerts, programs, and services provided at the Event if necessary. Visitors are not entitled to object in the event of a modification of the program.


9.2. The Visitor is aware that not all services at the Event are provided by Everness, and that when using certain services, the legal relationship is established directly between the Visitor and the Contributor, and the rights and obligations arising from the legal relationship belong to and are burdened by them. Everness does not assume any liability in relation to the products and services provided by its contractual partners.

9.3. Everness is not responsible for items left unattended in the Event area, including items left in tents, cars, or accommodations.

9.4. The visitor declares that the data provided by him/her during the ticket purchase is true. Everness is not liable for any damage resulting from inaccurate data.

9.5. The visitor acknowledges that Everness cannot be held liable for any misuse or damage arising from any payment method (e.g. unauthorized use of a bank card, unauthorized transfer, etc.).

9.6. The Visitor is fully responsible (both in civil and criminal terms) for any damage caused by him (his child or pet) to Everness, the Venue, its contractual partners, collaborators, other Visitors and third parties. The Visitor accepts responsibility for any damage caused during the event without limitation by entering the event.

9.7. The Organizer of Everness Events shall be held liable solely within the framework of the laws in force at the time of the Event(s) and the GTC related to event services. Beyond this scope of responsibility, the Organizer shall directly transfer liability for any damage caused by any third party (Visitor, Partner/non-own personnel, etc.), regardless of the attribution, to the person causing the damage, which personal liability shall be acknowledged and accepted by all persons present during the Event and in its area upon entry.



  1. COPYRIGHT AND TRADEMARKS

10.1. The logos, trademarks, information and materials appearing on Everness' website, Facebook page, Events, all online and offline media, as well as on posters, flyers, etc. are the exclusive property of Everness and its contractual partners and these marks may not be used, copied or displayed by Visitors or third parties without the prior written consent of Everness or its contractual partners.


10.2. Everness is entitled to use the Visitor's comments, suggestions and ideas regarding the Event without restriction and without compensation.



  1. VIS MAIOR

In the event of any unforeseen and unavoidable obstacle (war, riot, strike, natural disaster, severe storm, epidemic, fire, etc.) due to which a party is unable to fulfill its contractual obligations and this cannot be attributed to it, then this party is not liable for any loss or damage that occurred as a result of this event.


If information from different sources is contradictory, the following order should be followed in determining the governing regulation:

Primarily: Announcement(s) announced by the Event Organizer,

Secondary: The official Rules of the given Event

Tertiary: Information on admission tickets

Quarterly: GTC

 



  1. FINAL PROVISIONS

12.1. InSpiral Event Kft. is a business company registered in Hungary and having its registered office in Hungary, whose legal transactions are governed by the rules of Hungarian law.


In matters not regulated in these regulations, the following shall apply: Act IV of 1959 on the Civil Code, Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society, Joint Decree 4/2009 (I.30.) of the NFGM-SZMM on the detailed rules for indicating the selling price and unit price of products and the fee for services, Act LV of 2012, Act CLV of 1997 on consumer protection, Act CLXIV of 2005 on trade, Act LXXVI of 2009 on the general rules for the commencement and continuation of service activities, Government Decree 210/2009 (IX.29.) on the conditions for carrying out commercial activities, Act XLVII of 2008 on the prohibition of unfair commercial practices towards consumers. Act XLVIII of 2008 on the Basic Conditions and Certain Limitations of Economic Advertising Activities, and the provisions of Hungarian law in force at the time of the Event shall apply.

12.2. Everness is entitled to use subcontractors and collaborators for any of its activities.

12.3. The Contracting Parties agree to the exclusive jurisdiction of the 11th District Court of Budapest for all matters related to these GTC and the Event, as well as for the services provided by Everness.

12.4. Everness employees will receive questions, comments, ideas, and possible complaints related to the Event at the Event Center operated at the location of the given Event, or at the e-mail address info@everness.hu.
